Courier Subcontractor Terms & Conditions

1. Acceptance of Work

Acceptance of any booking constitutes agreement to these Terms & Conditions. The subcontractor accepts responsibility for completing each booking professionally, safely and within the agreed collection and delivery times.

2. Vehicle & Insurance

• Vehicle must be roadworthy, taxed and MOT compliant (where applicable).
• Valid Goods in Transit Insurance must be maintained.
• Hire & Reward Insurance must remain valid.
• Public Liability Insurance where applicable.
• Driver licences must remain valid.
• All UK transport legislation must be followed.

3. Collection & Delivery Times

• Drivers must arrive on time.
• Any delay must be reported immediately.
• Customers must not be contacted directly without permission from dispatch.
• Drivers must follow all booking instructions provided by the Company.

5. Failed Collections

A collection may be classed as failed where the subcontractor:

• Fails to attend.
• Refuses the load without reasonable justification.
• Arrives too late to complete the collection.

The Company reserves the right to cancel payment, recover replacement costs and suspend future work.

6. Delivery Delays

Where delays are caused by the subcontractor's negligence, payment deductions may be made to reflect compensation paid to customers, additional transport costs or financial losses.

7. Driver Cancellation

• Bookings become binding once accepted.
• Cancellations within two hours of collection may result in recovery of replacement costs.
• Repeated cancellations may result in suspension.

8. Communication

• Drivers must keep their phone switched on.
• Calls from dispatch should be answered promptly.
• ETA updates must be provided when requested.
• Collections and deliveries must be confirmed immediately.

9. Proof of Delivery

Payment may be delayed until satisfactory Proof of Delivery (POD) has been received. Electronic signatures or photographs are acceptable where authorised.

10. Damage or Loss

• Drivers are responsible for goods while in their possession.
• Loads must be properly secured.
• Damage must be reported immediately.
• Failure to report damage may result in liability for losses.

11. Professional Conduct

• Professional behaviour is expected at all times.
• Suitable clothing must be worn.
• Customers must be treated respectfully.
• Health & Safety rules must be followed.
• No smoking, alcohol or drugs while undertaking bookings.

12. Confidentiality

Customer details, pricing information and Company business information are confidential and must not be shared with third parties.

13. Non-Solicitation

Drivers must not approach or undertake work directly for any customer introduced by the Company for a period of 12 months without written permission.

14. Payment

• Payment will be made according to the agreed payment terms.
• Invoices must be submitted where required.
• The Company may deduct any sums due under these Terms.

15. Waiting Time Policy

60 min free for vans, 60 min for 7.5t+; waiting payable only if approved before free period expires.

16. Right of Set-Off

The Company reserves the right to deduct from any payments due any reasonable costs, losses, overpayments or compensation arising from the subcontractor's breach of these Terms.

17. Termination

The Company may suspend or terminate work immediately for:

• Repeated lateness
• Poor communication
• Customer complaints
• Dangerous driving
• Fraud or dishonesty
• Failure to maintain insurance
• Serious breach of these Terms

18. Governing Law

These Terms & Conditions shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
